Procedure in the Case of Child Abduction
In the cases when a person from Bosnia and Herzegovina requests returning or seeing of a child which is in some of the state parties of the Convention, the Ministry of Justice of Bosnia and Herzegovina, together with the request for returning or seeing of a child, delivers to the foreign central executive body the necessary documentation in accordance to the Convention on the Civil Aspects of International Child Abduction.
The Ministry informs the requester about the undertaken actions of the foreign central executive body, as well as about the relevant information obtained during the procedure.
Similar procedure is also applied when a request for returning of the child is sent by the person outside of Bosnia and Herzegovina, and the child is in Bosnia and Herzegovina. Then, after the request is received from the competent foreign central executive body, the Ministry of Justice of BiH establishes whether the request is written in accordance to the Convention, and if it is regular, it is forwarded to the competent entity Ministry of Justice, which further forwards it to the competent local court.
If the request is not completed, the Ministry of Justice will not reject it, but it will, through the central executive body of the requesting state, ask for the supplement and completing of the request in accordance to the provisions of the Convention.
